Terms of Use
Effective date: October 3, 2026
These terms are an agreement between you and Hyndsyt Inc. ("we") for the Hyndsyt app and its sharing features, Between Us and Backed. By creating a profile, you agree to them.
1. Who can use it
You must be at least 13 years old, and old enough to agree to these terms where you live.
2. Your account
- Your account is protected by a 24-word recovery phrase. Keep it private. We cannot recover it for you, and anyone with it can use your account.
- Choose a username that does not pretend to be someone else.
- You can delete your account in the app at any time.
3. No tolerance for objectionable content or abuse
You may not use the app to share, send or request anything that is:
- harassing, threatening, hateful, or abusive toward anyone;
- sexual content involving minors, or any illegal content;
- recorded or shared in breach of someone's privacy or the law;
- impersonation, spam, or fraud.
You can block anyone, and report a person or a moment from their page. We review reports within 24 hours. A report tells us who, why and which moment; it does not let us see or hear the moment itself, which stays encrypted. We may remove content we can see, and suspend or close accounts that break these rules, without notice.
4. Recording and sharing what's around you
The Witnuss and the app record sound, and Company lets friends you pick hear what's around you as it happens. Laws about recording conversations, and about letting others hear them, differ by place, and many require everyone's consent. You are responsible for following the law where you are, and for what you choose to save and share.
5. Backed is not an emergency service
Backed lets friends you choose know where you are and hear you if you send a Flare. It does not contact emergency services. Alerts depend on phones, signal, batteries, notification settings and people being available, and can fail. If you are in danger, call your local emergency number.
Company is not an emergency service either. If you are in danger, send a Flare or call your local emergency number.
6. Your content
What you record and share stays yours. You give us only the permission we need to store and deliver it, encrypted, to the people you choose. We cannot read end-to-end encrypted content.
7. The service
We work to keep the service running, but we do not promise it will always be available, fast, or free of errors. We may change or stop features.
8. Ending
You can stop using the app and delete your account at any time. We may suspend or close an account that breaks these terms.
9. Disclaimers and liability
The app and the Witnuss are provided "as is". To the extent the law allows, we are not liable for indirect or consequential losses, or for any failure of an alert to reach someone. Where the law allows a limit, our total liability to you for any claim is limited to the greater of what you paid us in the 12 months before the claim, or 100 Canadian dollars. Nothing in these terms limits any right you have under consumer protection laws that cannot be waived.
10. Law
These terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there.
11. Changes and contact
We will update the date above when these terms change, and tell you in the app about important changes. Questions: support@hyndsyt.io.
